MINUTE ORDER IN CHAMBERS. Before this Court are Plaintiff's motions at ECF Nos. 98, 106, and 107. Plaintiff's motions to compel (ECF Nos. 98, 106) are DENIED. The subpoenas at issue were authorized for the limited purpose of identifying newly named defendants in Plaintiff's first amended complaint. ECF No. 62 at 2. Plaintiff's recently filed second amended complaint supersedes the first, which no longer performs any function and is treated as non-existent. Ferdik v. Bonzelet, 963 F.2d 1258, 1262 (9th Cir. 1992). The previously authorized subpoenas similarly serve no function now, so Plaintiff's motions to compel compliance with them are moot. Plaintiff's motion for service via the U.S. Marshals Service (ECF No. 107) is DENIED. Plaintiff wishes to serve two summonses (ECF Nos. 39, 48) which were issued after the filing of Plaintiff's first amended complaint. As discussed above, that complaint is no longer operative, and these summonses lack information now available to Plaintiff. Plaintiff must properly complete new summonses for these Defendants. Fed. R. Civ. P. 4(b). He may refile this motion after properly completing summonses pursuant to Fed. R. Civ. P. 4(a)(1). (no image attached)

IT IS ORDERED that Anthony Mitchell's ECF Nos. 56 and 57 motions for a temporary restraining order and preliminary injunction are DENIED, and his ECF No. 92 motion to supplement those filings with additional evidence is DENIED as moot. IT IS FURTHER ORDERED that Mitchell's ECF No. 66 motion for leave to file the proposed second amended complaint at ECF No. 66-2 is DENIED. Mitchell must file a renewed second amended complaint that complies with Federal Rule of Civil Procedure 8 and that does not exceed 50 pages by July 22, 2026.
